Through the Site, we offer “being with”: a path of honoring our experience that can deeply support us to heal, integrate, reclaim our wholeness, and live who we are with more relaxation, warmth, and self love.

All visitors to our site, despite whether they register or not, are “users” of the Site. Users may register to sign up for our newsletter. Once an individual registers for our Services by subscribing to the newsletter, the user shall then also be considered a “member.”

You acknowledge, understand and agree that all of the forest llc trademarks, trade name, service marks, and other forest llc logos and any brand features, and/or product and service names are trademarks and as such, are and shall remain the property of forest llc. You herein agree not to display and/or use in any manner the forest llc logo or marks without obtaining forest llc’s prior written consent. 

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between you and forest llc and shall govern the use of our Services, superseding any prior version of this Agreement between you and us with respect to forest llc Services. You may also be subject to additional terms and conditions that may apply when you use or purchase certain other forest llc Services, affiliate Services, third-party content or third-party software.

CHOICE OF LAW

Our relationship and this Agreement is governed by and construed in accordance with the internal laws of the State of Oregon without giving effect to any choice or conflict of law provision or rule that would cause the application of laws of any other jurisdiction.

WAIVER AND SEVERABILITY

At any time, should forest llc fail to exercise or enforce any right or provision of the Agreement, such failure shall not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Agreement remain in full force and effect.

ARBITRATION

(a)  Except as provided in subsection (c) below, YOU AND FOREST LLC AGREE TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN ARBITRATION.

(b) Except as provided in subsection (c) below, ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT OR OTHERWISE) BETWEEN YOU AND US ARISING FROM OR RELATING IN ANY WAY TO YOUR PURCHASE OF PRODUCTS THROUGH THE SITE OR SERVICES, WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION. The arbitration will be administered by the Arbitration Service of Portland (ASP) in accordance with the ASP Rules then in effect. (The ASP Rules are available at https://www.arbserve.com/.) The Federal Arbitration Act will govern the interpretation and enforcement of this section.

The arbitrator will have exclusive authority to resolve any dispute relating to arbitrability and/or enforceability of this arbitration provision. The arbitrator will be empowered to grant whatever relief would be available in court under law or in equity. Any award of the arbitrator(s) will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction.

You agree to an arbitration on an individual basis. In any dispute, NEITHER YOU NOR FOREST LLC WILL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER CUSTOMERS IN COURT OR ARBITRATION OR OTHERWISE PARTICIPATE IN ANY CLAIM AS A CLASS REPRESENTATIVE, CLASS MEMBER OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. The arbitral tribunal may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding. The arbitral tribunal has no power to consider the enforceability of this class arbitration waiver and any challenge to the class arbitration waiver may only be raised in a court of competent jurisdiction.

(c)  You or we may elect to pursue a claim in small-claims court rather than arbitration if the claim is within the jurisdiction of small-claims court.

(d)  Venue for the resolution of any claim or dispute will be Multnomah County, Oregon.

LIMITATION ON TIME TO FILE CLAIMS

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THIS AGREEMENT OF USE, THE SITE OR SERVICES MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

DISCLAIMERS
